Terms of service

These Terms of Service ("Terms") govern your use of Engage Pickleball's services and website (collectively referred to as the "Service"). You agree to be bound by these Terms by accessing or using the Service.

1. Use of Service

1.1 You must be at least 18 years old to use the Service. By using the Service, you represent that you are at least 18 years old.

1.2 You agree to use the Service only for lawful purposes and in accordance with these Terms and any applicable laws and regulations.

1.3 You agree not to:

(a) Use the Service in any way that violates any applicable laws or regulations;
(b) Use the Service to engage in any fraudulent or misleading activities;
(c) Use the Service to transmit any viruses, worms, or other malicious code;
(d) Interfere with or disrupt the Service or servers or networks connected to the Service; or
(e) Attempt to gain unauthorized access to any portion of the Service.

2. User Accounts

2.1 In order to access certain features of the Service, you may be required to create an account. You agree to provide accurate and complete information when creating an account and to keep your account information up to date.

3.2 You may not reproduce, modify, distribute, or otherwise use any content from the Service without the prior written consent of Engage Pickleball.

4. Disclaimer of Warranties

4.1 The Service is provided on an "as is" and "as available" basis. Engage Pickleball makes no warranties or representations about the accuracy or completeness of the Service or the content available through the Service.

4.2 Engage Pickleball disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

5. Limitation of Liability

5.1 To the fullest extent permitted by law, Engage Pickleball shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for lost profits, lost data, or business interruption, arising out of or in connection with your use of the Service.

5.2 In no event shall Engage Pickleball's aggregate liability to you exceed the amount paid by you, if any, for your use of the Service during the twelve (12) month period immediately preceding the event giving rise to such liability.

6. Governing Law

6.1 These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of laws provisions.

7. Changes to Terms

7.1 Engage Pickleball reserves the right to modify or update these Terms at any time. Any changes to these Terms will be effective immediately upon posting on the Service. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
